1. Acceptance of the Terms
By creating an account, purchasing a service, or using any product from Kroma Lab, you confirm that you are at least 18 years old, that the information you provide is true and complete, and that you agree to be bound by these Terms and Conditions, as well as the specific policies for each service described below.
2. Web Hosting Services
Our web hosting runs on infrastructure from internationally specialized providers, which lets us offer NVMe SSD, automatic backups, and high availability. By using this service, you agree that:
- Your plan's resources (storage, bandwidth, processes, email) are subject to fair, reasonable use. Excessive consumption that affects other customers may result in a temporary resource limitation and, if it persists, in account suspension.
- Hosting illegal content, malware, phishing, or botnets is not allowed, nor is using the service to send unsolicited email (spam).
- We reserve the right to monitor server resource usage solely to protect service stability for all our customers.
- If your project grows and consistently exceeds the limits of a shared plan, we will contact you to suggest migrating to a VPS before taking any restrictive action.
3. VPS Servers
Our VPS servers run on enterprise-grade cloud infrastructure with availability guarantees. When you purchase a VPS:
- You receive root access and are responsible for the configuration, security updates, and administration of software installed on your server, unless you've purchased managed administration.
- Kroma Lab makes reasonable efforts to ensure service availability, but cannot guarantee uninterrupted operation given the technical nature of the underlying infrastructure.
- Upon cancellation or expiration of the service, you have a reasonable subsequent period to back up your information before the data is permanently deleted.
- Using the VPS for illegal activities, unauthorized cryptocurrency mining, denial-of-service attacks, or any activity that compromises the network or third parties is prohibited.
4. Domain Registration and Management
Domain registration and management are processed through internationally accredited registrars and are subject, in addition to these terms, to the policies of the Internet Corporation for Assigned Names and Numbers (ICANN) and the registry for each extension. Therefore:
- You are responsible for keeping the contact information (WHOIS) associated with your domain up to date and accurate. Outdated information can cause you to lose access to critical notifications, including renewal notices.
- Domain ownership is yours; Kroma Lab acts as a registration intermediary and does not claim ownership of domains registered in your name.
- Domain activation, transfer, and release timelines depend on each extension's (TLD) registry policies and may be outside of our direct control.
- It is your responsibility to renew your domain on time. We recommend enabling auto-renewal to avoid losing your domain due to expiration.
5. Custom App and Site Development
For software, web, or mobile app development projects:
- The scope, delivery timeline, and cost of each project are defined in a specific proposal or quote before work begins.
- Intellectual property of the code and final deliverables transfers to the client once the agreed payment has been paid in full, unless otherwise agreed in writing.
- Scope changes requested after development has started may affect the project's timeline and cost.
- Maintenance services after delivery are governed by a separate agreement.
6. Billing, Payments, and Renewals
Services are billed in advance according to the cycle chosen at signup (monthly, annual, or other available option). Failure to pay may result in temporary service suspension and, if it persists, permanent cancellation. Prices may be updated; if so, you will be notified with reasonable advance notice before the next renewal.
7. Cancellations and Refunds
You may request cancellation of a service at any time through your client area or by contacting support. Refund conditions vary depending on the type of service and time elapsed since purchase; check with our support team for the conditions applicable to your specific case before requesting a cancellation.
8. Acceptable Use and Prohibited Content
Regardless of the service purchased, it is strictly prohibited to use our infrastructure to:
- Distribute malware, viruses, or hacking tools.
- Host content that infringes copyrights, trademarks, or other third-party rights.
- Carry out phishing, fraud, or identity theft activities.
- Host unauthorized adult content, material exploiting minors, or content illegal under applicable law.
- Send unsolicited bulk email (spam) or abuse email resources.
Violating this policy may result in immediate service suspension while the case is investigated.
9. Backups and Data Responsibility
We run periodic backups as an extra layer of protection, but this does not replace your own responsibility over your data. We recommend keeping independent backups of any information critical to your business. Kroma Lab will make reasonable efforts to assist with data restoration in the event of an incident, but does not guarantee full recovery in every case.
10. Intellectual Property
The trademarks, design, text, and proprietary code of the Kroma Lab platform are the company's property. Content you upload to your hosting, VPS, or development project remains your property; you are responsible for holding the necessary rights to that content.
11. Limitation of Liability
Kroma Lab will not be liable for indirect damages, or loss of revenue or data resulting from service interruptions caused by circumstances beyond our reasonable control, including infrastructure provider failures, third-party attacks, or force majeure events. Our total liability for any claim is limited to the amount actually paid for the service in question during the relevant period.
12. Privacy and Data Protection
The handling of your personal data is described in our Privacy Policy. We only collect the information necessary to provide the service, manage billing, and offer support, and we do not share it with third parties except when necessary to provide the service (for example, with domain registrars) or as required by law.
13. Changes to These Terms
We may update these Terms and Conditions to reflect changes in our services or legal requirements. For significant changes, we will notify you by email or through a visible notice in your client area with reasonable advance notice. Continued use of our services after an update constitutes acceptance of the new terms.
14. Governing Law
These terms are interpreted in accordance with Colombian law. Any dispute that cannot be resolved directly between the parties will be submitted to the resolution mechanisms applicable under that law.
